Legal Question in Business Law in Georgia
partnership
My huband died leaving all assets in businesses.(Corps.,llc's-small,closed)I was his only business partner and remaining officer,mgr.respectively.However,I did not understand this nor did all attorneys,banks,judge discover this.All business assets were transfered to probate and I lost all assets.Is my only,best legal form of restitution legal malpractice or should I be pursuing other avenues in conjunction with?(IRS,attorney generals office,media)This was a multi million dollar business.Thank you.

I cannot understand your situation from the way you describe it. "All business assets transferred to Probate..." does not happen here in Georgia. Whatever a person owns at death, including ownerships in businesses, passes according to his or her will if there is one, and if not, to his or her heirs at law - unless there are creditors of the deceased, and those creditors are paid before anyone can inherit anything. There is also something here in Georgia called Twelve Months Support which comes before creditors claims. You should seek the advice of an attorney concerning the options open to you. He or she would have to spend some time with you, and review the documents, before any advice could be given.

It is difficult to give you sound advice without consulting with you to review the situation in greater detail. I would have thought that you would have received his interest in any and all property he owned. I would advise you to consult with a local attorney ASAP.
