Proof of Trade Secret Misappropriation
What steps must a business take in order to prove that their customer list (a trade secret) was misappropriated by a former employee who has opened a competing business. The former employee states that he did not have access to and did not take the customer list. The business bringing suite claims that his customers are receiving advertisment mailings from the new business.

What you are asking is not a "legal" question but one of establishing matters of fact. I would recommend hiring a good investigator. Of course, since a suit has been filed both sides can avail themselves of the discovery process to see what can be ferretted out that way.
