Refusal of payment

Hello,

I recently took a freenlance illustration assignment witha local ad agency.

after doing what I thought was exactly what they wanted and to the best of

my knowledge, exactly what they had asked for, they are refusing to pay me.

They agreed in writing to my quote of $200 to which they are now refusing

and telling me that since I was unable to contiune the project (they needed a

style that I am uncapapble of doing) they feel they shouldn't pay. I disagree as

they agreed on my quote and I spent my time doing the initial art for them. I

was even nice enough to reduce my quote to $100 and they still refuse. What

are my options if they continue to refuse? I don't think $100 is worth hiring a

lawyer over, but I do feel strongly that I should be paid for my time and they

have my original art files that I have no way of knowing that they will in fact

use.

It sounds like you would have pretty solid claim against them for breach of contract, but even in small claims court, it would cost you ~$75.00 plus time, so I'm not sure if it would be worth it. However, there is something to be said for not letting them get away with it. I would file a claim in magistrate (small claims) court for their breach and ask for all damages and costs and attorney's fees.
