Legal Question in Business Law in Georgia

The need to register a trade name

We import textiles from South Africa. Do the companies we represent need to register their company names in the United States in order for us to sell their products wholesale in the U.S.?

International business matters are beyond the scope of this forum, and we know nothing about the business. Check with a lawyer.

Re: The need to register a trade name

It depends on many factors, including facts about your business as well as where the products are coming from. Generally speaking, your company would not be responsible for other companies' registration. I would recommend speaking with an international business attorney.

Re: The need to register a trade name

Just to add to Glenn & Scott's responses, only the company doing business here needs to follow these formalities. However, if you are asking about protecting their trademarks, it probably would be a good idea to protect the intellectual property of the companies you represent. In addition, you would need to comply with any treaty regulations, import laws and taxing statutes. International trade can be a tricky area, so you probably should seek legal advice, even if only to make sure you are in compliance with these laws.
