Legal Question in Business Law in Georgia
restock
I ordered some handrail for customer, they did not want them so I returned them. The supplier took them back then sued me for the money which I have now paid , but they will not give me the handrails. What can I do to get them to give the handrails back?
Thanks

Re: restock
Did you pay the full amount or merely a restocking fee? If you paid the full amount, you're entitled to them.
Re: restock
The magic words are they sued you. Time to get a lawyer well in advance of any deadlines.
Re: restock
Both Mr. Riddle and Gottlieb are correct. Because they have filed suit against you, you probably should counter-sue for the handrails. However, dealing with a lawsuit is very complicated and you should get an attorney ASAP.

Re: restock
If what you paid is the cost of the materials, you should quickly consult with a local attorney about what may be frivilous litigation. There are penalties for this.
