Sales Comissions
I am a sales person for a company located in Georgia. I receive sales comissions on the 15th of every month, based on what the company has received from the 15th or the previous month to the 10th of that month. My Q is this: I have signed contracts representing $6,000 from sales in December, and may place additional business earning an additonal $8,000 in sales between the 1st of January and 15th. If I were to give my '2 week notice' on the 15th, is my employer leagally bound to pay comissions on contracts that have been turned in from the month of December, and from my efforts in the 1st 2 week of January. To my knowledge there is NO specific language or agreement which specifies that I am elegibile for comissions till the last day of my full tiem employment. My Q pertains to the comissions rights of the employee. What I'm afraid will happen is that a % of clients will send 1st month payments prior the 15th of Jaunary, and that sales made between the 1st of Jauary and 15th of January will not be recieved by employer as late as the 15th of February. If I have signed contracts in house am I elegible to receive comissions even if I am no longer employed by them?
