Legal Question in Business Law in Georgia
Shipping error
I was buying a product from a company for a gift for my son. It was shipped and they received it, only to find that there was two of the item. I looked at my invoice and it only said I had ordered one. That night my bank account was billed again for the same amount. The amount was 350$ So i was billed 700$ for something I only ordered one of. Is there any legal action I could take upon them? Could I keep the item I received and tell them to take off the amount that I did not pay for?

Re: Shipping error
"Legal action" for what? A court case so you can sue to keep something that was sent to you by mistake? You left out the part of the story where you called the company and told them about the error? That is the obvious first step when mistakes are made. Most likely, they will reverse the charge and offer to pay for the cost of shipping the second item back. If you accidentally shipped a gift to the wrong address, would you expect the person to keep it (or sue to keep it), or to be an honest, reasonable person of character and simply resolve the mistake? A expect most people would not see a dilemma here.
