Legal Question in Business Law in Georgia
Small Claim
I am filing a small claim against someone for a business contract against my client. Am I filing this claim against the person or the business. I happen to know that the business folded during the time that we were under contract. I need to know whether the claim can be served at the business address since I have verified that the rent has been paid through the end of June 2009. Do I need to find an alternative address to have the paperwork served?

Re: Small Claim
Not knowing who to sue is a good sign you should not be trying to handle this yourself. No one here can possibly tell you who to sue or where to serve them.
Re: Small Claim
What you need to do is consult with a local attorney. You may well create a mess with bad consequences.
Re: Small Claim
It probably depends on who the contract was with - the business or an individual, or both. And was any part of the contract personally guaranteed by anyone. If the company is dissolved, you may have a claim against an individual owner if not dissolved properly, but only in certain circumstances. Otherwise, there is no one to sue.
