Legal Question in Business Law in Georgia
I'm a student and have a question about business law. The case is about a large corporation that manufactures termite eradication products. Several of the companies customers are considering filing a suit stating that the product is ineffective. I'm wondering which court system would hear this case. I've done some research and it seems that most product misinformation cases are handled in state court and most states have UCL laws that I assume this would fall under; but, I'm a little confused. I have also read that these pesticides are regulated by the EPA and that the government agencies set standards, etc. for these products. So, I'm stumped as to which court would have jurisdiction in this case. I'm thinking that since the company itself is not a government agency, then it would be handled in state court. If so, when or would the government agency get involved? Also, who would be of help to the company in this situation - the agency who santioned this pesticide? Thanks for any help or clarity you can provide.
