Legal Question in Business Law in Georgia

I am suing my business partner because he left the company with half the assests and left me with all the debt. The day before our hearing, he called the court and told.them he filed for bankruptcy, so the cancelled our hearing. 45 days later, he has never filed! Can he get in trouble?

It depends. Actually filing bankruptcy stays the proceeding, not just saying you are going to. If that is what he did, you can notify the court in a motion or at a hearing, and it will be up to the judge on how to handle it.

If he lied to the court about filing bankruptcy, your attorney will know how to get him in trouble via an appropriate motion. Talk to him.
