Legal Question in Business Law in Georgia

Unfair competition

My husband and I have recently opened a gym named PT Gym (Personal Training)in a small town with a population of ~ 100,000. There is only one other gym in town that is any competition to us. They are family owned and have been in town for 20 years. They are much larger than we are. We are trying to hit a small section of the population with the emphasis on being much more personable and spending the time with our members (hence the name - personal training. The other gym is called West Side Athletic Club. He has recently been advertising more than he ever did in 20 years, but he is directly using our marketing emphasis. He is directly copying our bullet points in our ads. To top this off he has now changed his name to Westside Athletic Club AND Personal Training!! Is there any unfair competition relief for a small business (us)when the big fish in the pond is trying keep another business from getting into the market??

Thank you

Re: Unfair competition

You need to contact an attorney who is VERY familiar with the area of law collectively known as Patent, Copyright and Trademark law. This is outside my area of practice but I occasionally need to bring in such an attorney for my business clients. I use an attorney in Duluth, GA. If you would like his name and number, let me know.
