wrong vendor payment
I worked for a recruiting company for almost 2 years. I quit to go back and get my MBA and help my wife out with her home based recruiting business, not in same industry as I worked before. Recently checks came in and one came in from a client that I worked with at my previous employer and got deposited into my wife�s business account. At the beginning of the month we realized it was not for any placements we had done and the money was never touched in the business account. I got a call yesterday from and investigator about the check and wanted to speak with me to get my side of the story. I have not yet spoken with the investigator and wanted to see what your thoughts on the matter are. I told the officer yesterday that we realized the mistake and would give the money back to my former boss, the check was for 5,000. I contacted my former boss yesterday and told him the check was mistakenly put into my wife's business account and I would give him the 5,000 back, he told me explain it to the police. My question is can I get into any criminal or legal trouble over this, please let me know.

That is a criminal issue, not a business one. However, I can tell you that there would have to be some intent to kept the money at some point.
