Legal Question in Civil Rights Law in Georgia
if you afix a storage shed to a property and then decide to move can you take the storage shed
1 Answer from Attorneys
It depends. Did you rent or own the property? If you rented, what does your lease say, if anything, about fixtures? Usually, the rule is that if you attach something to the property, it becomes the property of the landlord except for things like "trade fixtures" (say restaurant equipment or things like that). In such case, you can take them but you have to fix any damage to the propert caused by their removal. If the lease is silent, then talk to the landlord and if the landlord permits removal, then make sure the property is restored to its original condition.
If you own the property and decide to sell, what does the offer to purchase say about the shed? Is it to remain or not? In such case, I would ask the buyer in case it is not clear.
