The right to be free of harrassment by the government ?

On the 13th of this month my House was surrounded by 8 to 10 police officers, My wife was harrassed, yelled at, my youngest son was yelled at they walked over my yard looking through personal property, uncovered my yamaha 4 wheeler forced my wife to call me home from business I had to take care of, They decided they had the wrong house and then went to my sons house with the same Gestapo tactics, told him he was not under arrest then handcuffed him and put him in the squad car for questioning, this all took place in front of all our neighbors and was a great emberrassment to us all, my son was haulled out of his house in his under shorts. Was this not a violation of our rights the officers had no reason to link either of us to the high speed chase they claim they were under, ?

Which local authority was this? Did the officers explain to you they had a warrant to search your home? Are there any important details you have left out concerning the reasons they singled out your home and your son's? If the officers do not have a warrant, the factual circumstances become even more important. It is best if you can contact a local attorney and ask for an opinion.

You need to determine on what information the police were using to justify their behavior. Contact the City or District Attorney. File a claim against the City to clear the way for the filing of an action . . . you have approx. 6 mos to file the claim (in L.A.)Then you'll know whether they had a reasonable basis upon which to act, or wether they simply acted maliciously, or, at least, negligently.
