Legal Question in Civil Rights Law in Georgia

Report of sexual harassmant caused a hostile work environment

I was sexually harassed by a supervisor at my prior employer. After I reported this supervisors conduct to his superiors I had to work in a very deliberate hostile environment. I was intimidated, ridiculed ,criticized and made an emotional wreck. My supervisor was given instructions to make me so miserable that I would quit. This incident happened several years ago and I did not retain an attorney (even though I knew I had a strong case) because I had several family members working for this company and did not want them to suffer any retribution because of my actions. Is is too late for me to seek damages relating to this issue? This is a multi-million dollar corporation and I have witnesses to everything that occured (the majority of which are currently employed at this company).

Thank You

Re: Report of sexual harassmant caused a hostile work environment

Unfortunately, it is probably too late for you to file any claims. The statute of limitations for filing a sexual harassment charge with the EEOC under Title VII of the Civil Rights Act is 180 days, and you cannot file a lawsuit under Title VII without first going through the EEOC. There are state laws that might apply, and they generally have a two year statute of limitations. Such laws might include intentional infliction of emotional distress, negligent retention and negligent supervision. Usually, but not always, these state claims are more difficult to prove than Title VII claims.

The foregoing is general information only, not specific legal advice. No attorney/client relationship has been created or should be implied. I recommend that you check with an attorney before taking legal action.
