Legal Question in Civil Rights Law in Georgia
Can somebody show me the money?
Hi, I am presently trying to sue for a loan, but the person is proving to be a slippery snake. His wife on the other hand is very easy to find, She says they are separated and she does not have knowledge of his whereabouts. I gave him a check and on the back of my returned check copy she is a co-endorser. Will I be able to sue her also ?

Re: Can somebody show me the money?
Yes. You can go after her as well,--she signed the back of teh check, she received the funds, whether he ultimately got the money or not.
A check is a promise to pay a third person from you to the bank. her signature was only required if her name was on the check as a payee. THe fact that she endorseed it, leads me to believe that she was intended as a recipient. In any event, if she can't prove they're separated, you could go after any joint accounts they have anyway.
