Legal Question in Civil Rights Law in Georgia

My son, who is 16 years old, was charged this weekend with a minor in possession of alcohol. He went to a party with his cousin, who is 20 y/o) and his cousin had brought my son and his friend home and then was caught (cousin) at a nearby restaurant and charged with public drunkenness. He was questioned as to where he had been and who he was with and when the cousin told the cops who he was with they told him to lead them to where these others (my son and his friend) were. The cops went to the house where my son and his friend were and proceeded to have them woken up and then discovered my son was intoxicated. Then he was charged with this MIP How do the cops have permission to question my son when he was 1) without his parent and 2) in the bed asleep? Should I get legal representation for when he goes to court?
