if someone is staying at my house but is not on the lease can i kick them out that day

A temporary guest, yes. Someone who is living there, lease or not, no. If you are leasing the house, and not the owner, you have additional possible problems such as whether you having someone violates your lease. It depends on all the facts you left out.
