Terroristic Threats
What is the liability of an employer, who fails to prevent and or act upon incidents where an employee is subjected to, harassed/threatened with items such as racist propaganda, such as nooses, flags etc.

It depends. From your post, it seems as if the company knows that these activities are ongoing. If that is the case, the company could be subject to a claim of a racially hostile environment. However, there is a lot of information missing that is necessary to determine whether or not there may be any liability. You should contact an attorney to see.
