The copyright laws are very complex and a short answer to your general question would take hundreds of pages.

It wiould be foolish (and potentially financially ruinous) for you to even start your project without seeing an intellectual property lawyer. This is far beyond anything you can answer online.

The penalties for infringement are enormous, and you additionally need to protect your work.
