Domain Name-Trademark

I have recently purchased a domain name. The domianname happens to a be a "business name" in a nearby city. Our web site is going to be a "portal" for teh extreme sports industry, and has nothing to do with teh nearby business. What is my leagal right to the name? The other company has never registered the name.

Even though you own the domain name, you may run afoul of your state's business name registration or trade-name laws and, perhaps, federal law if the business has trade-marked it's name nationally.

A state's jurisdiction over internet sites which are available to it's states residents is still up in the air legally, but I expect it to come down on the side of protecting existing laws regarding the use of names.
