Fraudulent use of names when purchasing on the web.

Someone placed an order on the web using

my name and their own shipping address

and credit card number. I would simply

like to know how I can get that

particular merchant to remove my name

from their database, they said they

would not? And how can I legally obtain

that shipping address of the person who

is fraudulently linking my name to it?

And what in the world can I possibly do,

besides never ordering anything off the

web myself, to prevent this from ever

happening again?

How do you know that this happened because you bought something over the web? That seems unlikely to me; very few transactions that accept credit cards do so without first putting you on a secure server (https:// for example).

I would make a threat to the merchant ... charges of fraud on their part if they won't remove your name. Alternatively, with a lawyer, bring suit against them (probably not in small claims, though) in which you can subpoena the name of the other person from them. I'd name the unknown other party as a party the suit also.
