Legal To VideoTape in Stores, Restaurants, etc?

Is it legel to videotape using a body mounted hidden camera in a store, restaurant, etc? The video may be used to send to the media or to the corporation, or to the corporations competition.

Please advise.

Re: Legal To VideoTape in Stores, Restaurants, etc?

You need to ask a lawyer in your own jurisdiction, since videotaping may violate your state's laws. We just had a case here in MA wherein a driver videotaped very inappropriate conduct by some police officers who had pulled over his car; he was prosecuted for taping the episode, I think under our wire-tapping statute. Under those circumstances, there was much media attention given to what appeared to be a gross mis-application of the law, and I don't know how the case ended. But in your case, where you intend to use the tapes for commercial purposes, there would seem to be no public-policy reason not to prosecute such conduct, if indeed your state prohibits it.

Best wishes,
