Legal Question in Constitutional Law in Georgia
My boyfriend went to probation and they gave him a urine test and said he failed so he asked for them to send it off to the lab and his probation officer said he wasn't going to and his probation officer wouldn't even let him see the urine test results. They gave him 124 days in jail. Isn't it illegal for them not to send the urine test to the lab when he requested them too and about not letting him see the urine test results?

When you make up "facts" you can't get a valid answer (in this case I assumeyour boyfriend told you about half the story). Probation officers can't sentence someone to jail. Only a judge could sign such an order. Ask your boyfriend what really happened at the hearing, and what motions his attorney filed (if he chose to be his own attorney, ask him why he did something that foolish, and what motions he filed).

Probation officers can't sentence someone to jail (they can ask for his arrest, but they can't sentence or revoke). Only a judge could sign such an order. Obviously, staying clean on probation and hiring a lawyer for any hearings are the two basic things he needed to do.
