Builders Upgrades

We currently live in California and purchased a new home in Georgia that is being built. We were quoted a price for wrought iron railings with oak handrails as shown in the model by the builders design center and after we signed for the upgrades, returned the executed copy via fax to the design center, we received an email from their associate advising that the price that we signed for did not include the upstairs that there would be an additional cost of $3,400.00.

Are we responsible for the additonal cost or should the builder honor the upgrade sheet and waive the additional cost?

It depends on what was agreed to, if anything. You would need to look to the paperwork and determine what the original price applied to. I doubt that they could force you to pay for the additional work, but they might not be required to do the upstairs without further payment.
