I have given my contractor a down payment. His business partner took the money out of the account.
Together we want to obtain our money back. What type of attorney and how do we file?

If the money was stolen, call the police. Otherwise, retain a lawyer experienced in, and specializes in, business disputes (not a lawyer claims to handle any kind of case to get a fee). Ask other lawyers or business associates for referrals for lawyers in the area.
