EIFS SYSTEM [ fake stucco]

What are my rights for faulty EIFS SYSTEM ?

I had it tested & there is water damage behind it. The builder turned it over to their insurance co. The house was 6 years old July 24. The CO was July 18,95.

I filed this complaint to the builder in May 2001.Do I a lawyer to help me with this process? The insurance company is really Dragging their feet. They do not comunicate. Thank you for your help.

Re: EIFS SYSTEM [ fake stucco]

The statute of limitations for defective construction of houses purchased from the builder is six years.Otherwise the statute of limitations is 4 years. The six year period runs from the date that the Certificate of Occupancy was issued on your house. It appears to me that the SOL occurred last month. To prevent the limitations bar from preventing your right to sue for recovery, you had to file your case in court by the end of the six year period. You need to talk to a lawyer to confirm this situation.
