Legal Question in Construction Law in Georgia
Improper Grading of Property
I purchased a new home on December 13th, 2002. Since then, I have noticed my lawn retains an unusual amount of water. I have had 2 landscaping companies come out to look at the property and both have advised me that the lot was improperly graded. When I contacted the builder, they have denied that it is improperly with no foundation at all. What are my options now?

Re: Improper Grading of Property
You need some ammunition. Get a couple of written estimates from landscape companies to remedy the problem along with a written description of the problem. Then demand that the builder fix the drainage or pay to have it fixed. If you have a homeowner's warranty check to see if your coverage will remedy the problem, if not, and your builder will still not fix the drainage, you have the ammunition to go to small claims court against the builder.
