Lien on property by sub-contractor
My builder has not paid for the sheetrock material and labor that was installed in my new home, even though I wrote him the check back in November of 2005. The sub-contractor placed a lien on the property preventing us from closing until it is paid. This week we received a summons from the court in our new county to be responded to within 30 days. It states that the builder has refused to pay for the sheetrock and labor and now the sub is suing us for the money. Do we have to pay for this twice? It is $9,495.00.

It sounds like the subcontractor is trying to obtain a judgment against you. You may find that it is worthwhile to hire an attorney to represent your interests in attempting to get your builder to respond appropriately.
