Legal Question in Construction Law in Georgia

Mechanics Lein

I need to file a mechanics lien against a job we are doing for a contractor for the Georgia DOT. I have no idea at all what the do's and don'ts of a mechanics lien are. I need to know what rights I have and what I can and can not do. Their contractors bill is now up to $30000.00 and they are 7 months past due. I am at my wits end. Please advise.

I hate to cop out with advice, but given the issues, I would suggest that you get in touch with a local construction attorney as soon as possible (ie, next week). Mechanics Liens have strict filing requirements and deadlines, and it looks like you may be dealing with public property, which raises other issues -- ie, you can't put a lien on it and must look to the contractor's bond. $30,000 is not something you want to take a chance on. You also need to know the best way to proceed to protect yourself for future work if you can't lien the property.
