Accountability for over withdrawl of an automatic bank withdrawl

A monthly automated electronic withdrawl from my bank account wth progressive insurance company has been instated for the past two years. For the month of December 2005 there was mistakenly a double withdrawl due to an error by progressive which they admitted to. Because of this error several items purchased by me drafted my acount below sufficient funding and was charged a fee several times over for a total of $270.00 . Progressive claims that they are not responsible for the NSF fees but have promised to return the over withdrawl within 24 hours. I am wondering if there is any chance that they should be responsible for these fees as well as any other that may yet show up due to other online purchases yet to be debted.

It is a completely unreasonable position for them not to refund those fees. Ignore the customer service department and contact the office of the President of the company, letting them know that the people you did deal with did not act properly. Do that in a polite letter, address personally to the President or CEO (find his name and info ontheir website).

Should that not work, report them to the state insurance commissioner and consider suing them in Magistrate's Couyrt (which is small claims court).

Obviously, if an insurer mistreats you this way, look for a new insurance company, as if they can't handle this, they may treat you as badly with a claim.
