Legal Question in Consumer Law in Georgia

attorney fraud

My attorney forged my name(mispelled my signature), cashed the check out of state.... on a settlement check from an insurance company, after claiming he never settled. He has since surrendered his license to practice in Georgia. He can not be located....what recourse do I have? Please Help.

Your recourse is probably to file a lawsuit. I am sure all the facts are far beyond what you posted, and what can be answered on this board. You need a lawyer.

In addition to filing a lawsuit against your former attorney, you MUST file a complaint against him with the State Disciplinary Board of the State Bar of Georgia. I know that he has surrendered his license to practice, but you need to file a complaint any way. The Georgia Bar has a program called the Clients Security Fund that in some, limited, circumstances will reimburse consumers for some of the loses they suffered at the hands of an attorney.

So you have a two-prong attack: sue the guy and file a complaint against him in order to later seek compensation from the Clients Security Fund. You will need an attorney to file suit and that person should also handle your complaint as well.

Other than filing a complaint with the State Bar (which you most certainly should do) you are going to need to find the attorney before you can take legal action against him and/or his insurance company. If you will contact me, I will give you the number of a private investigator I use.
