Legal Question in Consumer Law in Georgia
auto
My son signed finance papers for a new truck Sat. 10-13-05. He was not able to drive out with the truck., because the dealership has to get it from another dealership. Test drove one just like it w/exception of color & power pkg.per the dealership.
if he gets there tomorrow to pick up the truck & it's not the right truck as we were promised what legally is his options? Can he still walk away from the deal? We have the vin no# on the sales contract but not being able to see the truck at the time we are not sure it going to be right one. Should have waited to sign the papers when the dealership got the truck. Spoke to the dealership today to make sure it has a bed liner (sprayed) like the other truck we were looking at & he was evasive. Thank you Jan

Re: auto
If you contracted to buy a particular car, you wouldn't have to accept a different car and the dealer would be in breach of the contract.

Your son is only obligated to take the vehicle for which he contracted, unless the fine print states otherewise. Be prepared for some heavy-handed threats from the seller. CONSULT WITH A LOCAL ATTORNEY.
