Legal Question in Consumer Law in Georgia

bought take out food from fast food from a big name burger joint . while eating food. a needle stuck into my gum.. called them an told them . the accused me of lying first and then the representative call and said that the owner wanted to give me a 25.00 gift card for. my trouble. how do i sue them . i was willing to settle but they have truly insulted me.

The exact total you get in court if you sue someone for making you feel insulted is less than zero - you get zilch and in fact you likely will have to pay their loawyers for frivolous litigation.

Unless you can prove extensive medical injuries (and that they put the needle there), take out a big mortgage on your house, as you will need all that money to pay their legal fees.

You should have accepted the gift card.

You left out the part where you went to the hospital to get checked out, and you had actual damages? People lie about such things all the time in order to extort an easy check. If it really happened, obviously you should go to the doctor and get checked out for your own health. If you didn't, that makes your story less credible.

It's very likely that you now have AIDS since you were pricked by a needle. I strongly suggest you to go a doctor and see if you contracted any diseases. If you have, rejoice! You have a very strong lawsuit on your hands, and I would love to be your lawyer and sue the burger joint.
