Legal Question in Consumer Law in Georgia

My Dad had a tin roof placed on his garage, which was leaking. The business refused to fix it. We took it to the BBB & they determined the business was at fault & should fix the roof. They never did & we are taking them to small claims court in Ringgold, GA. Howver, the garage burnt 4/21/08 & our proof is gone, except for the letter from the BBB that says the business was at fault & should repair the roof that part of the contract he had was invalid. He had tried to charge more for what should have been included & we would not pay. So since we don't have pictures now, what are our chances in small claims court. I have documents where we tried to get him to come repair it, phone/mail/BBB records but that is all, no photos. We could take a witness, if they are physically able.

We don't know what our chances are of winning the claim or if we should just drop it. What would our best bet be?

A letter from the BBB (a private, chariable organization) is not "proof," or even evidence, that is relevant to your court case. The Judge is unlikely to even consider it (unless it contained something like a signed statement by the builder admitting a relevant fact). Since it is small claims, you'll have to deide whether it is worth going to the hearing to see how the Judge rules.
