car deal gone bad

im in a ch13 my mother financed a vehicle for me on 1/24/09 we received a call 2-3 weeks that the bank would not finance my mother because i would be the driver the salesman did not disclose this information to them. 2/20/09 the dealer financed thru another bank and the deal cannot go thru now because my mothers licensed exp as of 3/6/09 which she cannot renew until she takes a DUI class so the dealer ship has asked for the car back can i get my down payment back

What did they say when you asked them that question (the obvious first step before creating an issue)? What does the paperwork say - we do not have it? Read your paperwork, and call them and ask.

In addition, call your bankruptcy lawyer and ask how the Ch. 13 Trustee and court would view you making a down payment or payments on a car in someone else's name, or not disclosing that you are doing so - if you have not disclosed it already,

Maybe yes but probably no depending on the language of the agreement, which none of us have seen.
