Can a car dealership keep the down payment if they are not able to finance you?

That depends on what the contract says. You read it obviously and for some reason don't want us to know, so we can't answer you.
By the way, before you go car shopping again, learn how to protect yourself. Since when you sign a contract you want this not to happen, get preapproved by a lender before you go shopping. If the dealer offers better terms, great. If not, you don't have the problem you caused.
