Legal Question in Consumer Law in Georgia

Car Title Dispute

I purchased a vehicle from a relative. I just made the last payment to her. She has decided to add interest to the loan and will not relinquish the title. We had a verbal agreement. I do, however, have a copy of a contract she prepared, which I did not sign (she had some ridiculous requirements in it). The contract states the purchase price and payment amounts - with no interest. I called the Magistrate Court and was told they only handle matters of ''dollars and cents''. How can I get my car title?

Re: Car Title Dispute

You may wish to consider filing an action against your relative in Magistrate Court, provided that the value of the car does not exceed the statutory limit of Magistrate Court jurisdiction.

It is correct that the Mag Ct does not have the power to vest title in you. However: use the court as a hammer. Figure out the "dollars and cents" you are out and sue her for that amount. My bet is she will come around.
