Do I have a case?
I bought a Webkinz stuffed animal and found a cigarettte butt inside of it. When I contacted Ganz, they said they would send me a new one, and a box to send the defected one back. They haven't done anything. Can I sue? What is covered under consumer law? They are made in China where a lot of other toys have been recalled.

Sue for what? A lawsuit (time, energy and your money) to get a refund of how many dollars? 10-15? That appears to be the extent of your damages (at most, since you do not even say how the cigarette butt damages the product). What does your situation have to do with other recalls? You need to deal with the retailer or manufacturer to get a refund, rather than consider how a few dollars of possible damages is worthy of a lawsuit.
