Legal Question in Consumer Law in Georgia
I'm Being Charged For Their Error
Complaint:
05/31/2006: I took my car in for a diagnostic test. 06/01/2006: I received a call explaining that a wire had to be replaced and for parts & labor it would cost $43?.00
I agreed for them to do the job. Later that evening I received another call informing me that it was not the wire but instead it was the motor that controls the censor and the price would be $831.00. I asked how long would it take, I was told a day or two. I agreed for them to do the work. 06/02/2006: I paid $800.00 toward the $831.00 price, I was told the car would be ready by the end of closing. At 5:55pm I called to auto shop and asked what time did they closed they replied ''6:00pm'' I asked about my car. I was told the wrong part was sent and now it would cost $1,181.00 to fix my car. This was now the 3rd time they changed the price, I told them it was not my error that they ordered the wrong part so why do I have to pay for their error. I asked for them to either fix my car at the $831.00 price in which they have $800.00 of my money or refund my money. I was told that I still had to pay for the labor. 06/06/06 I was told they would return my car in the same condition and they will be charging me for labor charges.

Re: I'm Being Charged For Their Error
If you protected yourself properly, you have rights here. If you didn't you're possibly stuck.
The ONLY way one should ever do a car repair is to get a written work order that requires you okay to exceed the listed estimate and keep a copy. If you got that you are protected. If not, you are likely stuck with whatever the bill may be. You might be able to get some help in such a case with the Better Business Bureau or Governor's Office of Consumer Affairs.
