Legal Question in Consumer Law in Georgia
A check is made out to the insured and the mortgage company for a settlement on a house that is burned. The insured does not agree with the amount paid and is holding the check. Does she legally have to pay the mortgage company listed on the check the balance on the home with that check?

If the parties do not agree, there is no "settlement" and there would be no check. You won't get much help if you leave out most of the facts.

If you haven't agreed on the amount, there isn't a settlement to divide. Discuss this with your attorney.
