contract
my original gas co no longer provides service in my area and i was switched to a new co. they say i have a fixed rate and to change it i will be charged a cancellation fee because i have a contract. i don't recall a contract so i asked for some sort of proof of this contract and was told i need to contact the gas co that i originally had service with. my thought is, if you say i have a contract then its your burden to prove i do. Is my assumption correct? i don't feel like i should be charged a cancelation fee because there is not proof of a contract. can they charge me this fee?

You are correct. I would insist that they produce the contract. Consult with a local attorney.
