Legal Question in Consumer Law in Georgia

Contractor

I hired a contractor lately and he finished work and I paid him. A vendor he used (and did not pay) now has placed a lien on my house.

I will pay the vendor. Do I pursue the contractor through small claims court or can I call the police and report him through theft by deception?

Please advise what to do.

With murder, rape, big drug cases, etc. running rampant (and being at the top of the totem pole in terms of getting attention), I doubt you can find a prosecutor who will give a case like yours much effort. I would go the small claims court route if your claim is under $15,000.00. You can get the forms at your local courthouse.

You would have to ask a criminal lawyer to get a comprehensive answer, but I don't think the contractor's actions would rise to the level of criminal without more facts. Of course, you would be able to pursue a civil claim against the contractor. If the total claim is $15,000 or less, you may file in small claims court.
