Legal Question in Consumer Law in Georgia
what is debt collection limitation
A collector called me on phone, said she is with AMEX and she had in her hand a debt from 1987 for $1000.00 and wanted collection information. I would not give her any info but, she willing gave the full name and social of the person she is calling about and disclosed the billing info. Is is legal for her to pursue a debt of almost 20 years old? My ex and I filed bankruptsy in the 80's and a second time in the 90's. Thank you.

Re: what is debt collection limitation
The easy answer is that if you and your ex (I imagine that they are trying to collect on your ex) filed bankruptsy, the debt has more than likely been discharged. The statute of limitations in Ohio on a written debt collection is very long and may still be a collectable debt but for the bankruptsy. Good Luck
