Dispute with auto mechanic

My husband's truck was running bad he took it to the auto repair shop of a co-worker's son-in-law. The mechanic said it needed a new motor & it would cost $3,500. He wanted $2,000 upfront so my mom put it on her credit card so we would be covered if there was a problem. He said we could get the truck in two weeks and make payments on the balance. Three weeks later he demanded another $1,000 before we could take the truck. Again we arranged for my mom to put it on her CC. The engine has a warranty that is 3 years/75,000 miles. The truck never ran great but it was Christmas so we decided to give it a some time. By the end of January we could not drive it. It was doing the same thing as before. We reluctantly paid another $50 on the balance but we knew we needed to take it back. The day we returned he came out swearing and yelling at my husband saying we owed him $800. My husband said the work was not up to par and the engine was acting the same as before. The mechanic drove it & said there was a problem. They agreed it would be fixed & upon pick up the $800 would be paid. Now 2 months later he says the motor is bad and the company is fixing the problem. We called the company they have no record of his call. Legally what can we do?
