extended vehicle warranty reimbursement

I purchased an exteneded warranty when I bought a used car. Upon trading the vehicle, I contacted the warranty co for a reimbursement of the unused warranty only to find out I had no warranty. Upon speaking to the dealer, I was told the dealer had sent a check to the warranty co. and it had never been cashed. Since I had the car for a year, they would mail me a refund for the pro-rated amount. I still have not received reimbursement. Am I entitled to full reimbursement since a warranty was never issued? and is their a certain amount of time allowed to the dealer to pay a reimbursement?

Yes, you are entitled to a full refund. If the warranty company never cashed the check, then the dealer was never out the amount of that check and you never had a warranty on the vehicle so they do owe you the full amount. There is no set time limit for the reimbursement. You should just demand payment by a certain date-maybe give them 14 days-and inform them that you will file suit if they haven't refunded your money by then. If you have proof that the dealer was aware this whole time that the check was not cashed and you had no warranty on the vehicle, you could also potentially file suit for fraud. You might contact an attorney, depending on the amount of money you are dealing with here.
