Legal Question in Consumer Law in Georgia
Fradulant AKC registration papers.
I bought what I thought was an AKC registered Maltese dog(Gizmo) from Petland in Alpharetta, Ga in Feb. of 2006.� I paid $1500 for him.� A few months later I bought another Maltese from a breeder.� As puppies, they looked somewhat alike but as Gizmo grew he became quite large, around 12 lbs, Maltese usually do not get over 7 lbs (about one in a billion). My two dogs look completely different now. I contacted Petland on several occasions, they've had me bring Gizmo in 3 times to take pictures, measure, and weigh him. They have admitted that he is not a Maltese but a mix. They initially told me that they would refund at least $550 but when I contacted them
again yesterday� they told me to do what I had to do and slammed the phone
down, I've been dealing with them for at least 3 months now.� I don't want to replace Gizmo, I love the dog, but it's the principal of the
whole thing, I paid $1500 for a purebred and I think I should be compensated for the cost difference.� I have false AKC registration papers on him so the information I have on him is unknown. I am 55 years old and have never sued anyone in my life so I am unfamilure with the process and I would like to know if I have a legal case

You may have a breach of contract action, depending on the paperwork and related facts and documents. Have a lawyer review all of it, or if you are certain, consider small claims/Magistrate COurt. As an aside, don't buy dogs from stores -- only reputable breeders.
