Legal Question in Consumer Law in Georgia

Fraud

I am a victim of stolen identity and creditor refuses to forward copy of application or any signature verification. Equifax investigated and removed from the report August 2006 however, creditor has decided to continue to pursue and harass me and had sheriff serve me on 7/6/07. This account was not opened by me nor authorized for anyone else to open. Please advise further.

Note that if you do not properly answer the suit within 30 days, you will lose by default. Hopefully you have the paperwork from when you previously disputed the debt. You should meet with an attorney to be sure that a proper answer is done in time.

A creditor generally has no obligation to simply take your word for it, or accept an affidavit without question; otherwise, they would be flooded with such claims. Since you have been sued, the prudent course of action is to retain a lawyer and work it out (or defend). You need to do this well in advance of the answer deadline.
