Legal Question in Consumer Law in Georgia
gym contract and credit report
I'm sorry its in all capitals, i copied and pasted thanks for your service
QUESTION ONE: I HAVE TWO QUESTIONS:
I AM A MEMBER OF A GYM AND I'M MOVING AWAY. I SIGNED A ONE YEAR CONTRACT. I CALLED THEM TO LET THEM NOW THAT I WOULD BE CANCELLING AND THEY TOLD ME THAT I WOULD HAVE A 200.00 CANCELLATION FEE, HOWEVER, THIS WAS NOT IN MY CONTRACT. DO I HAVE TO PAY THIS?
QUESTION TWO: I PULLED MY CREDIT REPORT RECENTLY AND THERE WAS A LISTING FROM A MEDICAL BILL. I CALLED AND IT WAS BEING HELD AT A LAWYERS OFFICE. THE HOSPITAL VISIT WAS FROM 1994 (I WAS ONLY 9 YEARS OLD THEN). i EXPLAINED THAT I WAS A MINOR AT THE TIME OF THE VISIT AND THEY TOLD ME THAT THE REASON IT WAS ON MY CREDIT REPORT WAS BECAUSE WHOEVER TOOK ME TO THE HOSPITAL PUT MY SS# AS THE FINANCIALLY RESPONSIBLE PARTY. THEY ALSO SAID THAT THE ONLY WAY TO CLEAR IT WAS TO FILE CHARGES FOR FRAUD AGAINST WHOEVER SIGNED THE PAPER, WHICH WAS MY MOTHER. HOWEVER, I'M SURE THAT MY MOTHER WASNT TRYING TO COMMIT FRAUD. WHAT SHOULD I DO?

Re: gym contract and credit report
You tell us what is not in your contract, but you did not mention what is in your contract. Does it say anything about early termination? They may be giving you a break by offering to take $200 rather than require you to make all payments until the end of your contract. Generally, they are not responsible for your decision to move away. Get any settlement in writing.
As for you credit report question, a debt more than 11 years old should not be listed. Follow the procedures on the report.
