Legal Question in Consumer Law in Georgia
Hello,
I purchased a luxury car from a dealer in Atlanta who owns multiple dealerships. The car had full remaining warranty and clean car fax. I began noticing the car having major wind noise and problems with a door. I took the car in to find that it had been in a bad wreck, numerous things have been replaced. I contacted the dealer and they will not let me return it they say, only trade it (which they do not have another luxury car that I looked 6 months to find) or supposedly have been trying to find me another one "whatever". To get any correspondence I have to call them and he says "Im looking". I want my money back period. There was a disclaimer in the docs I signed that said "as is" but that was under false pretenses sense I was told the car was clean before I drove 200 miles to get it. The records for the car at the dealership are horrible. What can I do?????

I am not sure why you think the contract you signed, stating it was "as is," was under false pretenses because they said it was "clean" (whatever that means) and you drive 200 miles. DId you not sign the contract AFTER you drove to the dealer? Did you read the "as is" language, and note that you had better be sure about the condition of the car? If you had the opportunity to inspect the car, drive it, and perhaps even get it checked out by a mechanic, you have a tough road to get a refund.
